General Sales Conditions (EN)
ORDER CONFIRMATION AND GENERAL CONDITIONS
The order confirmation and the following terms and conditions of sale shall apply to all purchases from LGN LOUIS GABRIEL NOUCHI (MONONOKE SARL), unless otherwise agreed in writing.
The execution of a purchase order implies the acceptance of the conditions set forth in this order confirmation and the conditions of sale. This agreement may be terminated by LGN LOUIS GABRIEL NOUCHI (MONONOKE SARL) for any reason at any time.
CONTRACT
A binding contract shall be deemed to have been concluded when the purchaser has placed an confirm order (by e-mail, telephone or post) sign.
In cases where LGN LOUIS GABRIEL NOUCHI (MONONOKE SARL) accepts a cancellation of all or part of an order.
LGN LOUIS GABRIEL NOUCHI (MONONOKE SARL) reserves the right to charge the purchaser 50% of the reduced net value of the order. LGN LOUIS GABRIEL NOUCHI (MONONOKE SARL) reserves the right to treat unclaimed goods as a cancelled order.
DELIVERY
Unless otherwise agreed, all deliveries will be delivered within the delivery window ( )
The delivery times on the order confirmation are given as an indication. An extension of 30 days beyond the date indicated is legal and accepted by the Buyer.
The delivery date is the day of the exit of the goods from LGN LOUIS GABRIEL NOUCHI (MONONOKE SARL) to the Buyer. Refusal of delivery is the Buyer's only recourse in case of late delivery.
Shipping and handling are at the charge and paid by the customer.
CANCELLATIONS
If you choose to cancel an order after the last cancellation date, you will be charged 50% of the total amount of the order.
If you wish to cancel the order due to a late delivery by LGN LOUIS GABRIEL NOUCHI (MONONOKE SARL) the following two conditions must be met:
A. The delivery date confirmed by LGN LOUIS GABRIEL NOUCHI (MONONOKE SARL) must have been exceeded by 30 days.
B. However, you must send the cancellation request by registered letter with acknowledgement of receipt (postal mail or e-mail) to LGN LOUIS GABRIEL NOUCHI (MONONOKE SARL). LGN LOUIS GABRIEL NOUCHI (MONONOKE SARL) will legally have 15 days to deliver, this extension will start from the date of receipt of the registered letter by LGN LOUIS GABRIEL NOUCHI (MONONOKE SARL).
PRODUCTION
The goods delivered will be in accordance with the sample collection, as indicated.
Minor changes and modifications may be made by LGN LOUIS GABRIEL NOUCHI (MONONOKE SARL) without any claim on the part of the buyer.
AFTER DELIVERY & COMPLAINTS
The buyer shall immediately upon arrival of the goods inspect the goods received in terms of quantity and quality.
All complaints must be made by the Buyer in writing (by post or e-mail) and must reach to LGN LOUIS GABRIEL NOUCHI (MONONOKE SARL) commercial services no later than ten (8) days after the date of delivery of the goods to the Buyer, otherwise the goods will be deemed to have been accepted by the Buyer. Replacement or reduction of payment or credit note is the buyer's only recourse for defects in the goods.
For no reason can products be returned without having notified and received the approval of LGN LOUIS GABRIEL NOUCHI (MONONOKE SARL).
Complaints about separate products do not give the buyer the right to cancel other parts of the order.
PAYMENTS & CONDITIONS
Please refer to your order form for your terms of payment. After three written reminders (by post or e-mail) of late payment, invoices will be sent to our recovery service outstanding and legal department.
All prices are quoted exclusive of value added tax.
The terms of payment are 50% pre-payment on order confirmation and 50% on receipt of the goods unless otherwise agreed by both parties and indicated in the written order.
Discount valid only when the terms of payment are met. Overdue invoices will be charged at 8% annual interest.
The goods remain the property of LGN LOUIS GABRIEL NOUCHI (MONONOKE SARL) until the buyer has paid all the amonts due.
